WIGAN WARRIORS MATCH TICKETS ARE ISSUED SUBJECT TO THE FOLLOWING TERMS AND CONDITIONS:

All match tickets are sold subject to the provisions below, the rules and regulations of the DW Stadium, Wigan Warriors ‘The Club’, Super League (Europe) Ltd the Rugby Football League and any membership scheme operated by the Club from time to time.

2024 MATCH TICKET RIGHTS AND ENTITLEMENTS

1.1 All match tickets are non-refundable. The purchase of a match ticket shall constitute acceptance by the ticket holder of these Terms and Conditions. A breach of these Terms and Conditions shall render the ticket void and all rights conferred or evidenced by it shall be nullified. 

1.2 A match ticket gives you access to the match purchased. The club reserves the right to change its advertised fixtures without notice or without liability. Play cannot be guaranteed to take place on a particular date at any time.

1.3 Match tickets and any digital passes remain the property of Wigan Warriors and their use is subject to compliance with the terms and conditions of use.

1.4 Each match ticket / digital pass is valid for the advertised match date or any date to which a match is re-scheduled. In the event be a match is abandoned or postponed, no entitlements to refund shall be authorised. 

1.5 The Club reserves the right to re-locate reserved seats for safety or segregation reasons. The club cannot guarantee your seat will not be affected by adverse weather conditions.

1.6 Ticket Holders are not permitted to exit and re-enter the event, except in the case of an emergency. Patrons must inform a steward in order to ensure controlled and secure egress and access.

1.7 Match attendees are subject to ground regulations which are displayed in the Stadium and copies of which are available on request.

1.8 Standing is forbidden in seated viewing areas.

1.9 Entry into the event will be authorised on an event day only upon the presentation of a valid ticket by each ticket holder seeking to gain entrance. Individuals who have been banned from attending events by competent authorities or sport’s governing bodies in any jurisdiction, or who are considered as a security risk, are prohibited from entering or remaining in the event. On entering the events, the ticket holder agrees to abide by event regulations at all times. 

2. CHARGES

2.1 The price payable for each Ticket shall be as set out on the Club website or as otherwise notified by the Club from time to time.

2.2 The sale of each Ticket is subject to the Ticket Holder providing the Club with full payment of the relevant price.

2.3 The Club always tries to ensure that all initiatives, promotions, offers, pricing and ticketing information on the Club website and in other Club literature is correct, but errors may occur. As soon as the Club becomes aware of any pricing or product description error in relation to a 2024 Tickets which has been purchased, the Club will endeavour to inform the purchaser as soon as reasonably practicable using the contact details provided to the Club. The Club will then provide the purchaser with the option of reconfirming the order at the correct price/description or cancelling the order. If the Club is unable to contact the purchaser having made reasonable attempts to do so, the Club will treat the order as cancelled. If the order is cancelled or treated as cancelled, the Club will provide a full refund to the purchaser using the payment details provided. If valid payment details have not been provided, no further action will be taken by the Club.

2.4 To qualify for a concession price you must be equal to the age definitions as stated on 1st February 2024. Proof of age may be required.

2.5 To qualify for a junior price you must be equal to the age definitions as stated and still be in Primary or Secondary education on 1st February 2024. Proof of age may be required. Junior definitions relating to group experiences or packages may vary and some restrictions may apply.

3. MATCH TICKET CONDITIONS OF ISSUE

3.1 The issue of a Match Ticket and subsequent access to the Ground is subject to the Terms and Conditions of Entry. Use of a season ticket constitutes acceptance of the Terms and Conditions of Entry. Season Tickets are only valid if presented complete and not defaced or modified in any way.

3.2 Match tickets are for use of the supporters of the Club only. By applying for a match ticket and/or using the same you hereby warrant and represent that you are a supporter of the Club.

3.3 Except as where specifically allowed under these terms, or in extenuating circumstances at the discretion of Wigan Warriors management, 2024 Tickets are non-refundable.

3.4 Save as set out in clause 3.5 below, you shall not bring into (or use within) the Ground any equipment which is capable of recording or transmitting (by digital or other means) any audio, visual or audio-visual material or any information or data in relation to Match or any aspect of it.

3.5 Mobile telephones are permitted within the Ground, provided they are used for personal and private use only.

3.6 Save for official Club merchandise and/or other rugby related clothing worn in good faith, you shall not bring into, use or display within the Ground any sponsorship, promotional or marketing.

3.7 The Club reserves the right to refuse admission to, or eject from, the Ground any person who fails to comply the Terms & Conditions of Entry

4 GENERAL

4.1 To the fullest extent permitted by law, these conditions of issue shall be governed by and constructed in accordance with the laws of England and Wales and the parties hereby submit to the exclusive jurisdiction of the courts of England and Wales.

4.2 The Club reserves the right to change these Terms from time to time, and shall notify you of such changes if they materially affect your rights as a consumer. Any variations will be advertised on the Club’s website hosted at www.wiganwarriors.com

4.3 The invalidity or partial invalidity of any provision of these Terms shall not prejudice or affect the remainder of these Terms, which shall continue in full force and effect. If any invalid, unenforceable or illegal provision of this agreement would be valid, enforceable and legal if some part of it were deleted, the provision shall apply with the minimum modification necessary to make it legal, valid and enforceable.

4.4 The Club’s failure to exercise, or delay in exercising, any right, power or remedy provided by these Terms or by law shall not constitute a waiver of that right, power or remedy.

4.5 Notwithstanding any other provision in Terms and with the exception of any rugby authority, no other person other than you or the Club has any rights under the Contracts (Rights of Third Parties) Act 1999 to rely on or enforce any term of these Terms. Nothing in these Terms shall affect any right or remedy of a third party that exists or is available other than as a result of the aforementioned Act.

5. LOST OR STOLEN TICKETS

5.1 In order to gain admission to the Ground a Ticket must be presented in its entirety at every Match.

5.2 In the event that you forget your Ticket in respect of any individual Match, the Club shall not be obligated to admit you or issue any other form of ticket for that Match. If a Match Day duplicate ticket is issued, the Club may require payment of a non-refundable administration charge.

2024 SEASON TICKETS TERMS AND CONDITIONS

All season tickets are sold subject to the provisions below, the rules and regulations of the DW Stadium, Wigan Warriors ‘The Club’, Super League (Europe) Ltd the Rugby Football League and any membership scheme operated by the Club from time to time.

2024 SEASON TICKET HOLDER ADDITIONAL RIGHTS AND ENTITLEMENTS

1.1 A 2024 Season Ticket shall entitle a 2024 Season Ticket Holder to the full rights and benefits attaching to such season ticket for the 2024 season, subject to the provisions of these Terms. For the 2024 season this is the right to attend all home matches played at the DW Stadium in the regular Betfred Super League season. No rights are given to attend Play Off or Challenge Cup Fixtures.

1.2 The Club shall determine the applicable capacity of the Ground (the DW Stadium at Loire Dr, Robin Park Rd, Wigan WN5 0UZ) for each Match in its absolute discretion and shall have no liability to any 2024 Season Ticket Holder in respect of the same. This includes the Club determining (including where this is required by the applicable authorities from time to time) that Matches must be played behind closed doors, with no spectator access, or played with limited capacity.

1.3 For Matches played with the Ground at full capacity, the Season Ticket Holder shall be entitled to access the Ground for each Match as would ordinarily be the case. For the purposes of these Terms, the term “full capacity” means that the Club has sufficient available capacity in the Ground in order for all 2024 Season Ticket Holders to attend the applicable Match(es), even if the Ground is not operating at its maximum overall capacity for those Match(es). For example, if Government regulations and/or safety requirements allow the Ground to be operated at a sufficiently high percentage of its maximum capacity such that all 2024 Season Ticket Holders can attend, but restrictions remain in place which do not allow all other typical categories of spectator to attend (e.g. away fans and/or spectators who attend on a match-by-match basis), the Ground will nonetheless be considered to be operating at “full capacity” for the purposes of these Terms.

1.4 In any event of a national pandemic or further Covid-19 lockdown, Wigan Warriors have the right to apply relevant procedures outlined in the 2022/ 2023 season ticket terms & conditions.

2. CHARGES

2.1 The price payable for each 2024 Season Ticket shall be as set out on the Club website or as otherwise notified by the Club from time to time.

2.2 The sale of each 2024 Season Ticket is subject to the 2024 Season Ticket Holder providing the Club with full payment of the relevant price in accordance with this clause 2.2 or via the Ticket Finance Scheme (as applicable). 2024 Season Ticket Holders who provide the Club with debit or credit or Direct Debit Ticket payment details authorise the Club to use those details to fulfil payment of the price and other fees attributable to the relevant 2024 Season Ticket.

2.3 The Club always tries to ensure that all initiatives, promotions, offers, pricing and ticketing information on the Club website and in other Club literature is correct, but errors may occur. As soon as the Club becomes aware of any pricing or product description error in relation to a 2024 Season Ticket which has been purchased, the Club will endeavour to inform the purchaser as soon as reasonably practicable using the contact details provided to the Club. The Club will then provide the purchaser with the option of reconfirming the order at the correct price/description or cancelling the order. If the Club is unable to contact the purchaser having made reasonable attempts to do so, the Club will treat the order as cancelled. If the order is cancelled or treated as cancelled, the Club will provide a full refund to the purchaser using the payment details provided. 2.4 The Club reserves the right to cancel, without reimbursement, any 2024 Season Ticket purchased by any supporter who defaults on any payment, including payments scheduled pursuant to the Ticket Finance Scheme.

2.5 To qualify for a concession price you must be equal to the age definitions as stated on 1st February 2024. Proof of age may be required.

2.6 To qualify for a junior price you must be equal to the age definitions as stated and still be in Primary or Secondary education on 1st February 2024. Proof of age may be required. Junior definitions relating to group experiences or packages may vary and some restrictions may apply.

2.7 Booking fees.

2.7.1 No booking fees will be charges where a ticket is fulfilled digitally by print-at-home or NFC (contactless). For printed tickets, there will be a charge of £0.50 per booking (up to a maximum of 12 tickets). Where a ticket is printed and posted, there will be a charge of £1.50 per booking (up to a maximum of 12 tickets).

3. ADDITIONAL BENEFITS

3.1 No cash alternative is available for any of the benefits described in this clause 5.

3.2 Merchandise offers and discounts will be offered from time-to-time throughout the season and communicated through club channels and/or direct e-mail. These offers are only available in-store and are not currently available on orders via the wiganwarriors.com online store. The Club reserve the right of refusal at its absolute discretion.

3.3 10% Discount in club store for Adult, Senior, Young Adult and Youth Season Ticket Holders only. (On full prices purchases only)

4. SEASON TICKET CONDITIONS OF ISSUE

4.1 The issue of a 2024 Season Ticket and subsequent access to the Ground is subject to the Terms and Conditions of Entry. Use of a season ticket constitutes acceptance of the Terms and Conditions of Entry. Season Tickets are only valid if presented complete and not defaced or modified in any way.

4.2 Season tickets are for use of the supporters of the Club only. By applying for a season ticket and/or using the same you hereby warrant and represent that you are a supporter of the Club.

4.3 Except as where specifically allowed under these terms, or in extenuating circumstances at the discretion of Wigan Warriors management, 2024 Season Tickets are non-refundable.

4.5 Nothing in these Terms constitutes or implies an irrevocable entitlement to occupy the seat indicated on the season ticket in any subsequent season. The Club will outline it’s seat renewal policies at the point of sale of season tickets or their equivalent in each subsequent season.

4.6 Save as set out in clause 4.7 below, you shall not bring into (or use within) the Ground any equipment which is capable of recording or transmitting (by digital or other means) any audio, visual or audio-visual material or any information or data in relation to Match or any aspect of it.

4.7 Mobile telephones are permitted within the Ground, provided they are used for personal and private use only.

4.8 Save for official Club merchandise and/or other rugby related clothing worn in good faith, you shall not bring into, use or display within the Ground any sponsorship, promotional or marketing materials.

4.9 You shall not offer or distribute (either free or for sale by any person) within the Ground any consumer article or commercial product of any nature. For the avoidance of doubt this clause shall not prevent the lawful distribution of text publications in any format which do not infringe clause 6.8 where both the content and the publication are lawful in all respects and do not in the Club’s reasonable opinion constitute a threat to public order.

4.10 The Club reserves the right to refuse admission to, or eject from, the Ground any person who fails to comply the Terms & Conditions of Entry.

5.USE OF SEASON TICKET

5.1 Season tickets are issued for your sole use and you shall not resell, assign or (save as set out in clause 5.3 below) transfer or lend a 2024 Season Ticket or the benefit of it to any other person without prior written consent of the Club. For the avoidance of doubt (and by way of example only) a 2024 Season Ticket may not be offered as a prize in any promotion or competition nor transferred, lent or used for any other commercial purpose, save as expressly authorised by the Club.

5.2 2024 Season Ticket Holders are requested to bring photo ID to each Match they attend as spot checks may be in place. The Club reserves the right to reject entry to and/or eject any attendee who cannot satisfy the Club that they are the named 2024 Season Ticket holder.

5.3 You may only sell or transfer the 2024 Season Ticket to a Guest with the express written consent of the Club given at the Club’s absolute discretion. No such resale or transfer will be permitted except where the same takes place in respect of an individual Match and in consideration or no payment or benefit in excess of the face value of a ticket to that Match and such transfer does not take place during the course of any business or for the purpose of facilitating any third party’s business. Such resale or transfer to any Guest will be subject to the Terms and Conditions of Entry which will (save for any rights to transfer under this clause) apply to that Guest as if he/she was the original purchaser of the 2024 Season Ticket (and you must inform the Guest of this).

5.4 The 2024 Season Ticket will remain the property of the Club at all times and must be produced together with evidence of your identity if required to do so by an official, steward or employee of the Club or any police officer. The Club reserves the right to require the immediate return of the 2024 Season Ticket at any time.

5.5 Any season ticket obtained or used in breach of the Terms and Conditions of Entry shall be automatically void and all the rights conferred or evidenced by such season ticket may result in the holder being refused entry to, or ejected from, the Ground in respect of a particular Match and /or the cancellation and withdrawal in accordance with this clause 5.5.

5.6 In the event the Club cancels or withdraws a 2024 Season Ticket in accordance with clause 5.5 no refund shall be payable to the holder of the 2024 Season Ticket. The Club further reserves its right to take any legal action against any person(s) as it sees fit in connection with such matters.

6. CHANGES TO DATES REFUNDS AND EXCHANGES

6.1 No guarantees can be given by the Club that a Match will take place at a particular time or a particular date or at a particular venue. The Club reserves the right to reschedule any Match without notice and without any liability whatsoever.

6.2 Subject to Condition 2.3 above, a 2024 Season Ticket is not refundable and cannot be cancelled by the 2024 Season Ticket Holder during the course of the season. However, the Club will consider requests for a refund in exceptional circumstances or on compassionate grounds, on a case-by-case basis.

6.3 The cancellation rights granted to consumers pursuant to The Consumer Contracts (information, Cancellation and Additional Charges) Regulations 2013 do not apply to season ticket purchases. Consequently, purchasers of 2024 Season Tickets will not be able to cancel their 2024 Season Ticket purchases except in accordance with these Terms or as otherwise permitted by English law.

7. LOST OR STOLEN SEASON TICKETS

7.1 In order to gain admission to the Ground the 2024 Season Ticket must be presented in its entirety at every Match.

7.2 In the event that you forget your 2024 Season Ticket in respect of any individual Match, the Club shall not be obligated to admit you or issue any other form of ticket for that Match. If a Match day duplicate ticket is issued, the Club may require payment of a non-refundable administration charge.

7.3 If in the Club’s opinion, a 2024 Season Ticket is irreparably lost, stolen or destroyed, a duplicate season ticket shall be issued by the Club as soon as reasonably practical after the payment of a non- refundable administration charge. Only one duplicate 2024 Season Ticket will be issued to you per season and you will be required to sign a document confirming that the original season ticket is irreparably lost, stolen destroyed and indemnifying the Club against any direct or indirect consequences of such matter having being falsely represented or stated to the Club.

7.4 Should any 2024 Season Ticket which is applied for not arrive in the post after purchase, you will be required to sign a document confirming that the 2024 Season Ticket has not arrived and undertaking to immediately return the original season ticket to the Club should it come into your possession at any time. There will be no charge for the issue of a duplicate season ticket in this instance.

8. CHANGE OF CONTACT DETAILS

8.1 If you change your postal address, contact telephone number, or e-mail address during the season you must notify the Club as soon as reasonably practical via the Club ticket office. Contact details for the ticket office are available on the Club website at wiganwarriors.com. You can also update your Ticketmaster account on-line.

9. CANCELLATION AND WITHDRAWAL OF SEASON TICKET

9.1 Without prejudice to any other remedies it may have, the Club shall have the right in the case of any serious or persistent breach of the Terms and Conditions of Entry to cancel your 2024 Season Ticket. In the event of such cancellation no refund will be paid in respect of any unexpired portion of the 2024 Season Ticket. Without prejudice to the general nature of the above the following actions shall constitute serious breach of the Terms & Conditions of Entry:

9.1.1 Smoking in the Ground;
9.1.2 Persistent standing in the seated areas whilst the Match is in progress;
9.1.3 Sale or transfer (save as permitted) of the 2024 Season Ticket to any person; 9.1.4 Deliberate misuse of the 2024 Season Ticket;
9.1.5 The supply of any misleading information in any application;
9.1.6 Persistent swearing during the Match;
9.1.7 The throwing of any object within the Ground without lawful authority or excuse;

9.1.8 The chanting of anything of an indecent or racist nature;

9.1.9 Any misrepresentation in relation to clause 4.2;

9.1.10 Breach of the terms of any membership;

9.1.11 Any failure to pay or default of payment in respect of any sums owing to the Club (or any third party) in respect of this season ticket.

9.2 Subject to Condition 4.3 above, a 2024 Season Ticket is not refundable and cannot be cancelled by the 2024 Season Ticket Holder during the course of the season. However, the Club will consider requests for a refund in exceptional circumstances or on compassionate grounds, on a case-by-case basis.

10. GENERAL

10.5 Notwithstanding any other provision in Terms and with the exception of any rugby authority, no other person other than you or the Club has any rights under the Contracts (Rights of Third Parties) Act 1999 to rely on or enforce any term of these Terms. Nothing in these Terms shall affect any right or remedy of a third party that exists or is available other than as a result of the aforementioned Act.

11. DEFINITIONS

11.1 In these Terms the following words and phrases shall have the following meanings: “Conditions of Issue” means these terms and conditions governing the issue and use of a season ticket. “COVID- 19 Spectator Code of Conduct” means the Club’s COVID-19 code of conduct as is in force from time to time and as made available by the club at www.wiganwarriors.com and as displayed at the Ground. “Disability” means as defined in Schedule 1 “Ground” means the rugby stadium and all other locations owned, occupied utilises by the Club. “Ground Regulation(s)” means those Ground regulations issued by the Club from time to time that set out terms and conditions are granted entry to the Ground. “Guest” means a relative, friend, colleague and/or companion to the disabled who would be entitled to purchase a season ticket under the Terms and Conditions of Entry. “Match(es)” means any Super League Match in which the Club participates and that takes place at the Ground during the season. “Terms & Conditions of Entry” means each of the rules and regulations of the RFL

(Governing Body) Ltd, Rugby Football League Ltd and Super League (Europe) Ltd; the Ground Regulations; and these Terms. “Ticket Finance Scheme” means a finance scheme for the purchase of 2024 Season Tickets operated by V12 Retail Finance which is subject to V12 Retail Finance’s terms and conditions (which are available on the Club’s website and will be provided to any person who chooses to use the scheme). “2024 Season Ticket” means a seasonal membership for Club supporters (and/or any rights arising out of in or connection with any of the forgoing) for admission to certain Matches in accordance with these Terms. “2024 Season Ticket Holder” means the holder of a 2024 Season Ticket. Schedule 1 – Supporters with a Disability – Additional Terms and Conditions

11.1 The following additional terms and conditions shall apply to any supporter with a Disability that has been registered with the Club. A Season Ticket Holder with a Disability shall mean any 2024 Season Ticket Holder who has a physical or mental disability that has a “substantial” and “long term” negative effect on their ability to do normal daily activities.

11.2 A Season Ticket Holder with a Disability who can provide the Club with any of the following as proof of their disability shall be entitled to a free personal assistant ticket for each Match attended by the Season Ticket Holder with a Disability. The qualifying criteria is as follows (or as otherwise determined at the discretion of the Club):

11.2.1 Enhanced rate of Personal Independent Payment (PIP) for mobility; 11.2.2 Receipt of the Disability Living Allowance at Middle/Higher Rate; 11.2.3 Receipt of the Attendance Allowance;
11.2.4 Receipt of the Severe Disablement Allowance;

11.2.5 Blind or partially sighted registration certificate, Credibility Access Card; and/or 11.2.6 Any other special documentation at the discretion of the Club.

11.3 Proof of disability must be provided to the Club at least four (4) weeks prior to the start of the season. Where such proof is not provided, the Club reserves the rights to cancel the 2024 Season Ticket and the personal assistant ticket and/or charge the full price for the 2024 Season Ticket and to cancel the personal assistant ticket.

11.4 Any ticket (of whatever nature) provided for a personal assistant for a Season Ticket Holder with a Disability is provided in order for the personal assistant to care for the Season Ticket Holder with a Disability and is only valid when the personal assistant is accompanying the Season Ticket Holder with a Disability.

11.5 The personal assistant is not deemed to be a 2024 Season Ticket Holder in their own right and as such are not entitled to any other benefits to which a 2024 Season Ticket Holder is entitled. Should the personal assistant wish to attend the Match without the Season Ticket Holder with a Disability, the personal assistant must upgrade the supporter with a Disability Match ticket by paying the full Match ticket price and the personal assistant ticket must be returned to the Club. Failure to do so and any abuse of these Terms and Conditions by any personal assistant may result in ejection from the Ground and cancellation of the 2024 Season Ticket without refund. For the avoidance of doubt all personal companions/carers are required to comply with these Terms, including the Ground Regulations.

11.6 The personal assistant should sit with the Season Ticket Holder with a Disability to assist them and, whilst the Club accept that the personal assistant may be another supporter with a Disability or

a young person, the Club requests that the personal assistant is fully capable of meeting the needs of the Season Ticket Holder with a Disability. It should also be noted that when entering the Ground, the personal assistant must enter at the same time as the Season Ticket Holder with a Disability. Although a Season Ticket Holder with a Disability can enter the Ground on their own, the personal assistant will not be admitted without being in the presence of the Season Ticket Holder with a Disability.

11.7 Personal assistant tickets are transferable, however 2024 Season Tickets for the Season Ticket Holder with a Disability are not. Should any Season Ticket Holder with a Disability or personal assistant be found to be abusing these Terms or any other policy relevant to Season Ticket Holder with a Disability, the Club reserves the right to deny entry or to take further action (which may include the suspension and/or cancellation of the assistant tickets/ 2024 Season Tickets).

11.8 The 2024 Season Ticket for the Season Ticket Holder with a Disability can only be used by the named individual and is not transferable and details of the personal assistant must be provided to the Club.

11.9 The Club will make every effort to allocate the personal assistant with a seat adjacent to the Season Ticket Holder with a Disability, however, if this is not possible, the Club will allocate the closest available seat in proximity to the Season Ticket Holder with a Disability.

11.10 Please note that stewards and members of staff may carry out checks on all 2024 Season Ticket Holders. Any abuse of the concessionary scheme for Season Ticket Holder with a Disability will be dealt with severely and will result in the loss of the applicable 2024 Season Ticket and the right to eject the individuals from the Ground.

12 LIMITATIONS OF LIABILITY

The Club expressly excludes all liability resulting from:

12.1 any seat affected by adverse weather conditions.

12.1 any failure or delay by the Club in carrying out its obligations under the Season Ticket Terms and Conditions which is caused by circumstances outside the reasonable control of the Club;

12.3 the alteration of the dates and times of Matches.

12.4 the abandonment, postponement or cancellation of Matches or Matches being played behind closed doors or with limited/restricted attendance.

12.5 any failure to obtain a Season Ticket, Match ticket and/or replacements of the same due to the acts or omissions of any third-party postal service provider; and

12.6 restrictions to the view of the Match caused by virtue of the actions of other spectators. 6.6 The Club shall have no liability whatsoever for:


12.6.1 any indirect or consequential loss or damage of whatever nature; or

12.6.2 any of the following types of loss or damages, whether arising directly or indirectly: (i) loss of enjoyment, (ii)travel/accommodation costs, (iii) any loss or damage to or theft of property at the Ground, and/or (iv) any losses arising from a 2024 Season Ticket being used for commercial purposes (i.e. where the 2024 Season Ticket is not being purchased and used by a consumer).

12.7 For the avoidance of doubt, nothing in these Season Ticket Terms and Conditions shall exclude or limit the Club’s liability for:

12.8 death or personal injury caused by the negligence of the Club or its employees during the course of their employment;

12.9 fraud or fraudulent misrepresentation by the Club; or
12.10 any liability which may not be excluded or limited as a matter of English law.
